28 January 2021, Budapest – The Hungarian Competition Authority (GVH) has initiated proceedings against Vodafone and Magyar Telekom due to their allegedly misleading commercial practice on their mobile internet packages promoting unlimited access to certain social network applications.

         In October 2020, the GVH initiated a competition supervision proceeding against Magyar Telekom Nyrt. and in January 2021 another one against Vodafone Magyarország Zrt. for the same reason: the undertakings are allegedly promoting their mobile internet tariff packages with misleading claims about the unlimited use of certain social network applications.

         The advertisements in question may make the impression in consumers that, in addition to the amount of data included in the mobile internet package, they may use certain social network applications, which can (also) be installed on a mobile device.   However, it is likely that certain types of data traffic will reduce the amount of data available to the consumers, thus, the access to such contents is in fact not unlimited.

         The initiation of the competition supervision proceeding does not mean that the undertakings have in fact committed the infringement. The proceeding is aimed at clarifying the facts and thereby proving the alleged infringement. The time limit for the completion of the proceeding is three months which, where justified, may be extended on two occasions by a maximum of two months each.
